1. What the Platform is

1.1. OEMRecycler is an online marketplace. It gives independent salvage yards, dismantlers and parts sellers ("Sellers") the technical means to list used auto parts, and gives Buyers a way to find and order those parts.

1.2. For parts listed by third-party Sellers, the Platform is not the seller. The contract of sale is between the Buyer and that Seller. The Platform acts as an intermediary providing the service.

1.3. Where a listing shows OEMRecycler itself as the seller, we act as the Seller on the same terms as everyone else on the Platform.

2. Platform and Seller responsibilities

• The Seller who posted the listing is responsible for the condition, completeness and description of the part.
• Shipping, returns and warranty terms are set by each Seller within the minimum standards the Platform requires, and are shown on the listing or in the Seller's profile.
• The Platform is not responsible for the acts of third-party Sellers, but does review disputes and works towards a fair resolution.
• The full terms of dealing with Sellers are set out in our Terms of Service.

3. What information we collect

Depending on how you use the Platform, we may collect:

• Contact and identity information: your name, email address and phone number.
• Delivery information: shipping address, city, province or state, and postal or ZIP code.
• Vehicle information: VIN, make, model, year and the parts you are looking for.
• Seller information: business name, contact person, phone, address and payout details.
• Payment information: records of transactions. Full card numbers are never stored on our servers — card data is handled by our payment processor.
• Technical information: cookies, IP address, device and browser details, pages visited and actions taken on the site.

4. How we collect it

• When you place an order through the cart.
• When you register a Buyer or Seller account.
• When you fill in a contact form on the site.
• When you email us or contact a Seller through the Platform.
• Automatically, through cookies set by the site itself and by the analytics and advertising services we use (see section 8).

5. Consent and legal basis

5.1. We collect and use personal information on the following grounds:

• Your consent, given when you provide the information or use the Platform;
• Performance of a contract you are a party to — placing and fulfilling an order;
• Legal obligations, including tax and accounting requirements;
• Legitimate business interests — keeping the Platform running, secure and free of fraud.

5.2. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may mean we can no longer provide part of the service.

6. Why we use your information

• To place, process and pass orders to the relevant Seller.
• To connect Buyer and Seller so an order can be fulfilled.
• To run accounts and the features of the Platform.
• To process payments, payouts and refunds, and to keep proper records.
• To improve the site and understand how it is used.
• To send service messages about your order, and marketing messages you can opt out of at any time.
• To prevent fraud and keep the Platform secure.

7. Who we share it with

7.1. We do not sell personal information. We share it only to the extent needed to fulfil an order or run the service:

• Sellers: the contact and delivery details needed to process and ship your order.
• Carriers: UPS, FedEx, USPS, Canada Post, Purolator and freight carriers used for your shipment.
• Payment processor: Stripe, for handling payments and refunds.
• Analytics and advertising providers: Google and Meta, which receive technical data about your visit as described in section 8.
• Service providers: hosting, email delivery and similar technical services acting on our instructions.
• Authorities: where we are required to by law, or to protect our legal rights.

7.2. Service providers are required to keep the information confidential and use it only for the purpose we gave it to them for.

8. Cookies and tracking

8.1. The site uses cookies that are necessary for it to work — keeping you signed in and holding the contents of your cart.

8.2. We also set a first-party cookie that records how you first arrived at the site (for example, from a search engine or an ad). It is stored for up to 90 days and is used to work out which Seller orders came through the Platform's own marketing. It does not identify you personally.

8.3. Analytics and advertising services. We use third-party services to measure how the site is used and how our advertising performs:

• Google Analytics — traffic and behaviour statistics: pages viewed, time on site, device and approximate location.
• Google Ads — measuring which ads lead to orders, and showing our ads to people who have visited the site (remarketing).
• Meta Pixel — the same measurement and remarketing for advertising on Facebook and Instagram.

8.4. These services set their own cookies and receive technical data about your visit, including your IP address, device and browser, and the pages you opened. They act as independent controllers of that data under their own privacy policies. You can limit ad personalisation in your Google Ad Settings and in your Facebook or Instagram ad preferences.

8.5. You can block or delete cookies in your browser settings. Necessary cookies aside, refusing them does not stop you from using the site — though some parts of it will not work correctly.

9. How long we keep it

9.1. We keep personal information only as long as needed for the purpose it was collected for, or as long as the law requires.

9.2. Order and payment records are kept for the period required by tax and accounting rules.

9.3. Once that period ends, information is deleted or anonymised.

10. How we protect it

10.1. We apply technical and organisational measures to protect personal information against unauthorised access, loss, alteration and disclosure.

10.2. Data is held in a database with restricted access, and all traffic between your browser and the site is encrypted with SSL.

10.3. Only authorised people have access to personal information, and they are required to keep it confidential.

10.4. If a breach creates a real risk of significant harm, we will notify affected individuals and the relevant privacy authority as required by law.

11. Your privacy rights

You have the right to:

• be told what personal information we hold about you and why;
• access that information;
• have inaccurate, incomplete or out-of-date information corrected;
• ask us to delete your information, where there is no legal reason for us to keep it;
• withdraw your consent, including consent to marketing messages;
• complain to us and, if you are not satisfied, to the Office of the Privacy Commissioner of Canada or your provincial privacy authority.

Residents of Quebec and of certain US states have additional rights under local law. Contact us at the address in section 17 and we will handle your request under the law that applies to you.

12. Deleting your information

12.1. To have your personal information deleted, email info@oemrecycler.com from the address associated with your account.

12.2. We will respond within a reasonable time and delete the information unless we are required to keep it — for example, an order that is still open, or records we must retain for tax purposes.

13. Seller information

13.1. By registering as a Seller you agree that your business name, location and contact details may be shown to Buyers so they can ask about your parts.

13.2. When a Seller receives a Buyer's details in order to fulfil an order, that Seller becomes independently responsible for that information under applicable privacy law, and must use it only to complete the order.

14. Where your data is stored

14.1. The site and its database are hosted in Canada. Some service providers — for example payment processing — may process information on servers in the United States or elsewhere, where it may be subject to the laws of that country.

14.2. Where information is processed outside Canada, we use providers that are contractually required to protect it to a comparable standard.

15. Age of users

15.1. The Platform is intended for adults. We do not knowingly collect personal information from children. Buying on the Platform requires the legal capacity to enter into a contract.

16. Changes to this Policy

16.1. We may update this Policy by publishing a new version on this page with a new "last updated" date.

16.2. Continuing to use the site after a change means you accept the updated Policy.
